EU Updates Harmonised Standard EN 71-13 for Toy Safety Directive 2009/48/EC
On 5 April 2023, the European Commission has published Implementing Decision (EU) 2023/740, a complete list, to update the references to the harmonised standards under the Toy Safety Directive 2009/48/EC. This update affects standard EN 71-13.
With immediate effect (from 5 April 2023):
EN 71-13:2021+A1:2022 Safety of toys - Part 13: Olfactory board games, cosmetic kits and gustative games, shall be listed as a harmonised standard under the Toy Safety Directive. The previous version, EN 71-13:2021, shall be withdrawn from 5 April 2023.

*Note: The limit values in point (a) of Table 2 of clause 4.2 of standard EN 71-12:2016 (i.e. limits for elastomers toys intended for use by children under 36 months and intended or likely to be placed into the mouth) are lower than the limit values to be complied with set in point 8 of part III of Annex II to Directive 2009/48/EC.In particular those values are as follows:

The standard EN 71-13:2021+A1:2022 applies to olfactory board games, cosmetic kits and gustative games and supplementary sets. It specifies requirements on the use of substances and mixtures, and their amounts and concentrations in these games or kits.
Olfactory board game, is the toy, the purpose of which is to assist a child to learn to recognize different odours or flavours. It includes activities of smelling and/or tasting as olfactive recognition can be done by retro-olfaction. Cosmetic kit, is the toy, the purpose of which is to assist a child to learn to make products such as fragrances, soaps, creams, shampoos, bath foams, glosses, lipsticks, other make-up, toothpaste and conditioners. Gustative game (or “gustative kit” or “food kit”), is the toy, the purpose of which is to allow children to make sweets or dishes which involve the use of food ingredients such as sweets, liquids, powders and aromas.
Compared to the previous version, the standard EN 71-13:2021+A1:2022 has included that specification that the cosmetic kits and gustative games (and their supplementary sets) shall not be intended for children under 36 months. The lists of allergenic fragrances have been revised considering the Amendments (EU) 2020/2088 and (EU) 2020/2089 to Annex II to EU Toy Safety Directive 2009/48/EC.
